1. Introduction and Agreement
These Terms & Conditions (the “Terms”) govern the relationship between you (the “Customer” or “You”) and True Smile Co.,Ltd. (“We,” “Us,” or “Our”) regarding the travel and tour services booked through our website or directly with our agents. By booking a tour, trip, or any related service with us, you agree to be bound by these Terms and any additional terms and conditions that apply to your specific booking (e.g., supplier terms).
2. Booking and Confirmation
Booking Request: All bookings are subject to availability. A booking request is made when you complete the booking process and submit payment.
Deposit/Full Payment: A non-refundable deposit of 50% is required at the time of booking to secure your reservation. If the booking is made within 7 days of the departure date, the full payment is required immediately.
Confirmation: A booking is only confirmed once we have issued a written confirmation, which may be an email or a formal booking voucher. Until confirmation is issued, we reserve the right to cancel the booking without penalty.
Pricing: All prices are quoted in Thai Baht (THB) and are subject to change without notice until the booking is confirmed. What is included and excluded in the tour price is detailed on the specific tour page.
3. Payment Schedule
Final Payment Due Date: The remaining balance of the tour price must be paid no later than 1 days prior to the departure date.
Failure to Pay: If the final payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit.
4. Cancellations and Refunds
A. Cancellation by the Customer
All cancellations must be received in writing (via email) to contact@true-smile.co.th. Cancellation charges are based on the date we receive your written cancellation:
61-90 days or more before departure: Loss of deposit.
31-60 days before departure: Loss of deposit or 30% of the total tour cost, whichever is greater.
30 days before departure: 50% of the total tour cost.
7 days or less before departure: 100% of the total tour cost (No refund).
No Show: Failure to arrive for a tour is considered a no-show, and no refund will be provided.
B. Cancellation or Changes by True Smile Co.,Ltd.
We reserve the right to cancel or make changes to any itinerary if necessary due to unforeseen circumstances, Force Majeure (see Section 10), or operational reasons.
If a tour is cancelled by us before the departure date, the Customer will be offered a full refund or an alternative tour of comparable value.
We are not responsible for any incidental expenses you may have incurred as a result of the booking, such as visas, non-refundable flights, or other travel arrangements.
5. Changes and Amendments
Changes by the Customer: Any request for changes to a confirmed booking is subject to availability and may incur an administrative fee of 500 THB per change, plus any charges imposed by suppliers (airlines, hotels, etc.).
Transfer of Booking: Bookings are generally non-transferable. Any request to transfer a booking to another person must be made in writing and is subject to our approval and a transfer fee.
6. Travel Insurance
Travel insurance is mandatory for all our tours. You are responsible for obtaining comprehensive travel insurance that covers, at a minimum, medical emergencies, emergency evacuation, repatriation, trip cancellation, and curtailment. You must provide proof of valid insurance upon request.
7. Customer Responsibilities
Passports and Visas: You are solely responsible for obtaining and holding a valid passport, any required visas, permits, and vaccination certificates for the entire duration of your trip.
Health and Fitness: You must inform us of any medical conditions or mobility issues that may affect your ability to participate in the tour activities. We reserve the right to decline a booking if we believe the Customer’s health and safety would be compromised.
Compliance: You must comply with the laws, customs, and regulations of the countries visited and follow the instructions of our tour leader or guides.
8. Limitation of Liability
We act only as an agent for the airlines, hotels, tour operators, and other suppliers providing services. We make every reasonable effort to ensure that the services provided are as described. However, True Smile Co.,Ltd. is not liable for any loss, damage, injury, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle, or through the acts or defaults of any company or person engaged in conveying the passengers, or in carrying out the arrangements of the tour.
Our liability for any loss or damage suffered by you is limited to the total amount paid by you for the tour.
9. Documentation and Privacy
Accuracy of Information: You warrant that all information you provide during the booking process is accurate and complete.
Data Protection: We will handle your personal information in accordance with our Privacy Policy (which should be linked separately on your website).
10. Force Majeure
We will not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, civil strife, labor disputes, mechanical breakdowns, government action, fires, floods, pandemics, or adverse weather conditions (Force Majeure). In such an event, we reserve the right to postpone, reroute, or cancel the tour without liability to you.
11. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bangkok.
